These Terms of Service ("Terms") are a binding agreement between you and PrivMars ("PrivMars", "we", "us") governing your use of our VPN service, website (https://privmars.com), and apps (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.
1. Eligibility
You must be at least 16 years old (or the age of majority in your jurisdiction) and able to form a binding contract. The Service may not be available in, and you may not use it from, countries where VPN use is unlawful — that is your responsibility to determine.
2. Accounts
- You are responsible for keeping your credentials secure and for all activity under your account.
- Provide accurate information and keep your email current so you can receive service and billing notices.
- Notify us promptly of any unauthorised use of your account.
3. Subscriptions, billing & trials
- Paid plans are billed in advance for the chosen period through our payment processors.
- Unless stated otherwise, subscriptions renew automatically at the end of each period until cancelled. You can cancel anytime; cancellation stops future renewals and takes effect at the end of the current paid period.
- Any free trial converts to a paid plan only if you choose to subscribe; we will make trial terms clear at signup.
- Prices may change; we will give notice before a change affects your renewal.
- Refunds are governed by our Refund Policy (money-back window: 14 days).
4. Acceptable Use Policy
The Service exists to protect lawful privacy. You agree not to use it to:
- break any applicable law or regulation;
- send spam, run mass unsolicited messaging, or distribute malware;
- hack, attack, port-scan, DDoS, or attempt unauthorised access to any system;
- infringe intellectual-property rights or distribute pirated content;
- produce, store, or distribute child sexual abuse material (CSAM) or any content exploiting minors — this results in immediate termination and, where required by law, reporting;
- harass, threaten, defraud, or harm others;
- resell, sublicense, or share the Service beyond your plan's device limit, or circumvent device limits;
- place an unreasonable load on the network or interfere with other users' use.
We may suspend or terminate accounts that violate this policy, with or without notice depending on severity.
5. Devices & fair use
Each plan allows a set number of simultaneous devices. The Service is for personal use; commercial redistribution requires a separate agreement. We may apply reasonable measures to keep the network healthy.
6. Service availability
We work hard for high uptime but do not guarantee uninterrupted or error-free service. Networks, nodes, and routes may change, and access in heavily censored regions can vary. Live status is at https://privmars.com/status.
7. Termination
- You may stop using the Service and close your account at any time.
- We may suspend or terminate access for violations of these Terms, suspected fraud or abuse, or where required by law.
- On termination, your right to use the Service ends; provisions that by their nature should survive (e.g. liability, governing law) will survive.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. A VPN improves privacy but is not a guarantee of anonymity or security against every threat.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRIVMARS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
10. Indemnification
You agree to indemnify and hold PrivMars harmless from claims arising out of your misuse of the Service or violation of these Terms or applicable law.
11. Governing law & disputes
These Terms are governed by the laws of [JURISDICTION], without regard to conflict-of-laws rules. The courts of [JURISDICTION] have jurisdiction, unless mandatory consumer-protection law in your country of residence provides otherwise.
12. Changes to these Terms
We may update these Terms. Material changes will be posted here and, where appropriate, emailed to you. Continued use after the effective date constitutes acceptance.
